These Terms and Conditions (“Terms”) govern your use of the AquaWorx website, aquaworx.ca, and the services offered by AquaWorx. By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use our website or services.

Services:  AquaWorx provides repair, maintenance, and service for pools and spas. Our services are available to residential and commercial customers. By requesting our services, you agree to the terms and conditions of service as outlined on our website and in our service agreement.

Payment: Payment for our services is due at the time of service. We accept payment by interact e-transfer, credit card and cheque. If a cheque is returned for insufficient funds, we will charge a $50 fee.

Cancellation and Refunds:  You may cancel a service request at any time before the scheduled service date. If you cancel a service request within 24 hours of the scheduled service date, you will be charged a cancellation fee of 50% of the service fee. If you cancel a service request on the scheduled service date, you will be charged the full-service fee. Refunds will be given at the discretion of AquaWorx management.

Warranties: AquaWorx provides a 90-day warranty on all parts and labour for services provided. Any warranty claims must be reported within 90 days of the service date. AquaWorx will repair or replace any defective parts at no additional cost to the customer.

Limitation of Liability: AquaWorx shall not be liable for any damage or loss caused by the failure of equipment or parts, or any other cause beyond our control. We shall not be liable for any indirect, incidental, or consequential damages, including but not limited to, loss of use, loss of revenue, or loss of profits.

Governing Law: These Terms and the relationship between you and AquaWorx shall be governed by and construed by the laws of the Province of Ontario.

Entire Agreement:  These Terms, together with our Privacy Policy, constitute the entire agreement between you and AquaWorx regarding the use of our website and services.

Changes to: These Terms AquaWorx reserves the right to update these Terms at any time. We will notify you of any changes by updating the “Last Updated” date at the top of this page. Your continued use of our website or services after any changes have been made constitutes your acceptance of the new Terms.
